Waqf Amendment Bill 2025: What is the History and Reforms of Waqf in India?

What is WAQF?

WAQF refers to the permanent dedication to any movable or immovable property under Muslim law that is deemed pious, religious or charitable.

What is the history of the WAQF Act?

India has a long history in regulating and protecting WAQF properties because of their religious, social and economic value to the community.

  • The first step was the WAQF Act of 1954. Over the years, several changes have been made to strengthen the law, increase transparency and stop abuse of WAQF property.

What is the current system managed by WAQF in India?

The WAQF Act of 1995, administered by the central government, is an important existing law to oversee the WAQF. Here are the main institutions involved:

The main timeline of WAQF law

Over the years, India has seen several laws to improve the functionality of the WAQF system.

  • The Mussalman WAKF Verification Act of 1913: Allowing the creation of a family WAQF, which could later achieve charitable purposes.
  • In 1923, Mussalman WAKF Act: WAQFS’s financial accounts introduced transparency.
  • The Mussalman WAKF Verification Act of 1930: The WAQF legal support was given under the 1913 law.
  • WAQF Act, 1954: State WAQF Board was established for better oversight. The Central WAQF Council was established in 1964 to guide the state committee.
  • Amendment to the 1954 Act (1959, 1964, 1969, 1984): Continue to improve WAQF property management.
  • WAQF Act, 1995 (replacement of the 1954 Act): clearly defined roles of the Central Parliament, the State Parliament and the CEO. It also established a WAQF tribunal with civil court powers. Court decisions cannot be challenged in court.
  • WAQF (Amendment), 2013: Among these amendments, three members, including Muslim legal experts. Two female members of each state’s WAQF board need it. It is also prohibited to sell or give away WAQF properties, with the lease term extended from 3 years to 30 years to allow for better use of the property.

The Ministry of Ethnic Minority Affairs (MOMA) has carried out two main plans:

It provides government grants (GIA) and can also help state legislatures digitize WAQF records. It also supports recruitment of human and computerized

SWSVY offers interest-free loans and helps develop commercial projects on WAQF land.
